Entity: DivasWho Entertainment, LLC (“Company,” “we,” “our,” or “us”)
These Terms and Conditions constitute a legally binding agreement between DivasWho Entertainment, LLC and any individual (“you” or “attendee”) who accesses our website, purchases tickets, or attends any event organized, produced, or promoted by the Company. By purchasing tickets, using our website, or attending our events, you expressly acknowledge that you have read, understood, and agreed to be bound by the terms set forth herein.
Governing Law and Jurisdiction. This Agreement shall be governed by, and construed in accordance with, the laws of the State of New York, without regard to conflict of law principles. Any claim, dispute, or controversy arising out of or relating to this Agreement, the purchase of tickets, or attendance at events shall be resolved exclusively within the state or federal courts located in Erie County, New York, and you hereby submit to the jurisdiction of such courts.
Eligibility and Age Restrictions. All events produced or hosted by DivasWho Entertainment, LLC are strictly restricted to individuals eighteen (18) years of age or older. Entry will not be granted to anyone under the age of eighteen, even if accompanied by an adult, and no refund will be provided in the event admission is denied on the basis of age. A valid, government-issued photo identification may be required at the time of entry, and refusal or failure to present identification upon request shall constitute grounds for denial of entry without refund.
Scope of Services. DivasWho Entertainment, LLC serves as the producer, promoter, and organizer of live entertainment, including but not limited to drag performances, pageants, and special events. The Company may utilize third-party venues, contractors, and vendors to provide facilities, catering, beverages, and other services. The Company disclaims responsibility for the acts, omissions, or failures of such third parties, and assumes no liability for conditions, operations, or policies imposed by venue management or contractors.
Tickets, Refunds, and Exchanges. Tickets to events must be purchased only through official and authorized platforms designated by the Company, including but not limited to Wix Events. Unauthorized resale, duplication, or distribution of tickets is prohibited and may result in denial of entry without refund. All ticket sales are final and non-transferable. Refunds are only available if requested no later than seven (7) calendar days prior to the scheduled event date, and such refunds remain subject to the discretion of the Company. Requests for refunds submitted within fewer than seven (7) days of an event may be denied. The Company, in its sole discretion, may allow exchanges for tickets of equal or lesser value to another event. Tickets are purchased for the event itself, not for any particular performer or lineup. Accordingly, the Company reserves the right to modify or substitute event lineups, performers, or programming without notice, and no refunds or credits shall be issued due to such changes.
Conduct and Removal. The Company reserves the absolute right, at its sole discretion, to refuse admission to, or to remove from an event, any individual whose behavior is deemed disruptive, unsafe, unlawful, harassing, discriminatory, or otherwise inappropriate. Removal or denial of entry under this provision shall not entitle the attendee to any refund or credit. All attendees are required to comply with applicable federal, state, and local laws, as well as any additional rules and policies imposed by the venue.
Intellectual Property Rights. All trademarks, service marks, event names, logos, slogans, promotional materials, photographs, videos, and related content are and shall remain the exclusive property of DivasWho Entertainment, LLC. No individual or entity is permitted to copy, reproduce, distribute, publicly display, transmit, or otherwise exploit such intellectual property without the express prior written consent of the Company.
Photography and Media Release. Attendance at an event constitutes a voluntary grant of permission to DivasWho Entertainment, LLC to capture, record, or photograph the attendee’s likeness, voice, or image in any media format. Such content may be used, published, displayed, or distributed by the Company for promotional, archival, or commercial purposes without compensation to the attendee. Attendees waive any right of review or approval regarding such uses.
Force Majeure. The Company shall not be held liable, nor deemed in default, for any delay, cancellation, or non-performance of an event that arises due to circumstances beyond its reasonable control. Such circumstances may include, but are not limited to, acts of God, severe weather, fire, flood, strikes, labor disputes, pandemics, public health emergencies, government orders, acts of terrorism, war, power outages, venue closures, or other unforeseeable events. In such cases, the Company reserves the right to cancel, reschedule, or modify the event without liability, except as otherwise provided in its Ticket Policy.
Indemnification. You agree to indemnify, defend, and hold harmless DivasWho Entertainment, LLC, including its owners, officers, employees, contractors, affiliates, successors, and assigns, from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your conduct, your attendance at an event, or any violation of this Agreement.
Limitation of Liability. Attendance at live entertainment inherently carries certain risks, including but not limited to loud music, lighting effects, crowd interaction, and potential hazards. By purchasing a ticket and attending an event, you expressly assume all such risks. To the fullest extent permitted by law, DivasWho Entertainment, LLC disclaims all liability for personal injury, illness, property damage, economic loss, or other damages sustained in connection with attendance at its events. In no event shall the liability of the Company exceed the face value of the ticket purchased.
Dispute Resolution. Any dispute or controversy arising under this Agreement shall first be subject to good-faith negotiation between the parties. If a resolution cannot be reached, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association in Erie County, New York. The decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.
Amendments. DivasWho Entertainment, LLC reserves the right to amend, modify, or supplement these Terms and Conditions at any time. Updated Terms shall be effective immediately upon posting to the Company’s website. Continued use of the Company’s services or attendance at its events following such posting constitutes acceptance of the revised Terms.

DivasWho Entertainment, LLC respects your privacy and is committed to protecting the personal information you provide when purchasing tickets, visiting our website, or otherwise interacting with us. This Privacy Policy explains the nature of the information we collect, how we use and safeguard that information, and the rights available to you under applicable law, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). By accessing our website or purchasing tickets to our events, you consent to the terms set forth in this Privacy Policy.
Information We Collect. When purchasing tickets to our events through authorized ticketing platforms, including Wix Events, we collect your name, email address, and phone number. We may also collect transaction-related details such as ticket purchase history and event attendance. Payment information, including credit card numbers, is not collected by DivasWho Entertainment, LLC directly but is processed securely by Wix and its designated third-party payment providers. In addition, our website may automatically collect certain technical information, including Internet Protocol (IP) addresses, browser type, device identifiers, and usage data, through cookies and similar technologies.
How We Use Your Information. The personal information you provide is used primarily to facilitate ticket sales, confirm purchases, provide customer support, and communicate important information regarding events. We may also use your contact information to send you promotional messages about upcoming shows, offers, or other opportunities that may be of interest to you. If you wish to unsubscribe from marketing communications, you may do so at any time by clicking the “unsubscribe” link in the email or by contacting us directly.
Sharing of Information. We do not sell, rent, or trade your personal information to third parties. Your data may be shared only with trusted service providers and partners to the extent necessary to process payments, deliver electronic tickets, send email communications, or otherwise facilitate event operations. We may also disclose personal information if required by law, regulation, legal process, or governmental request, or when necessary to protect the safety, rights, or property of the Company, its employees, contractors, attendees, or the public.
Cookies and Tracking Technologies. Our website, which is hosted on the Wix platform, may employ cookies, tracking pixels, and similar technologies to enhance user experience, analyze traffic, and personalize content. Cookies are small files stored on your device by your browser. You may disable or restrict cookies through your browser settings; however, doing so may impair the functionality of certain website features.
Children’s Privacy. DivasWho Entertainment, LLC does not knowingly collect personal information from children under the age of eighteen (18). Our events are strictly limited to attendees age eighteen (18) and older. If we become aware that we have inadvertently collected personal information from a minor, we will promptly delete such data from our records.
Retention of Data. We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy or as required by applicable law. Certain information, including transaction and ticket purchase records, may be retained for legal, accounting, or tax purposes. Once retention is no longer necessary, we will securely delete or anonymize the data.
Security of Information. We take reasonable measures, including reliance on Wix’s encrypted platform and other industry-standard security protocols, to protect your personal information from unauthorized access, disclosure, alteration, or destruction. While we take these precautions, no system can be guaranteed to be completely secure, and therefore we disclaim liability for unauthorized access or breaches that occur beyond our reasonable control.
Your Rights. Depending on your jurisdiction, you may have legal rights with respect to your personal information, including the right to request access, correction, or deletion of your data; the right to opt out of certain processing activities; and the right to receive a copy of your data in a portable format. Residents of California may exercise their “Do Not Sell My Personal Information” rights under the CCPA. Residents of the European Union may exercise rights granted under the GDPR. Ticket policy

This Ticket Policy governs the terms under which tickets to events hosted by DivasWho Entertainment, LLC are issued, purchased, and used. By purchasing a ticket, you agree to the conditions described herein.
Age Restrictions and Identification. All events hosted by DivasWho Entertainment, LLC are strictly restricted to individuals eighteen (18) years of age and older. Attendees may be required to present a valid, government-issued photo identification along with a ticket containing a scannable QR code for entry. Any individual under the age of eighteen (18) will be denied entry without refund, regardless of circumstances.
Entry and Admission. Admission to an event requires the presentation of a valid ticket purchased through authorized channels, including Wix Events or other platforms designated by the Company. Tickets may be presented electronically or in printed form. Venue staff and security personnel reserve the right to conduct bag checks or deny entry to any person for failure to comply with safety, security, or identification requirements. Admission constitutes acceptance of all venue rules, policies, and regulations in addition to this Policy.
Seating and Accessibility. Unless otherwise specified, seating at events is general admission and is not assigned. The Company may attempt to accommodate group seating requests if such requests are communicated in advance; however, no guarantee of seating arrangements is provided. DivasWho Entertainment, LLC complies with the Americans with Disabilities Act (ADA) and strives to make reasonable accommodations for individuals with disabilities. Attendees requiring special accommodations are encouraged to notify the Company in advance so that appropriate arrangements can be made.
Refunds, Transfers, and Cancellations. All ticket sales are final and non-transferable. Refunds may only be requested up to seven (7) calendar days prior to the scheduled date of the event. Refunds requested within fewer than seven (7) days of the event are subject to denial at the discretion of the Company. In the event that an event is canceled by DivasWho Entertainment, LLC, all tickets will be automatically refunded to the original method of payment or credited toward a future event, at the Company’s discretion. If an event is rescheduled, all tickets will automatically transfer to the new date, and no refunds shall be issued unless required by law.
Performer and Program Changes. All tickets are sold for the event as a whole and not for any particular performer, lineup, or program. The Company reserves the right to alter, substitute, or modify the lineup of performers or event programming at its sole discretion. No refunds, credits, or exchanges shall be issued due to performer substitutions or changes to event programming.
Conduct and Removal. The Company reserves the right to refuse admission to or remove from the premises any individual whose conduct is deemed disruptive, unsafe, unlawful, harassing, discriminatory, or otherwise inappropriate. Removal or denial of entry under this provision shall not entitle the attendee to a refund or credit. All attendees must comply with venue rules, laws, and the reasonable directions of staff and security.
Photography, Recording, and Media Release. By attending an event, you acknowledge and agree that your image, likeness, and/or voice may be recorded, photographed, or otherwise captured by the Company, its representatives, or the media. You grant the Company the irrevocable right to use such media for promotional, commercial, archival, or other purposes without compensation. Unauthorized recording, reproduction, or transmission of any portion of an event is strictly prohibited.
Prohibited Items and Searches. Unless explicitly authorized by the venue, attendees are prohibited from bringing outside food, beverages, illegal substances, weapons, or hazardous materials into the event. Venue staff reserve the right to conduct reasonable searches of bags and belongings, and to deny entry to any person found in possession of prohibited items.
Assumption of Risk and Limitation of Liability. Attendance at live entertainment carries certain inherent risks, including but not limited to exposure to loud music, lighting effects, crowd interaction, or other hazards. By purchasing a ticket and entering the event, you voluntarily assume all risks associated with attendance. DivasWho Entertainment, LLC shall not be liable for personal injury, illness, property damage, or other losses arising from or related to attendance at an event. In no event shall the Company’s liability exceed the face value of the ticket purchased.
Amendments. This Ticket Policy may be modified, updated, or supplemented at any time by DivasWho Entertainment, LLC. Any revised Policy will be effective immediately upon posting to the Company’s website, and continued use of a ticket or attendance at an event following such posting shall constitute acceptance of the revised Policy.
